Isaac Berkower - Week 18 - Elon Musk and SpaceX are under investigation by the DOJ

A few weeks ago, it was reported that Elon Musk and his company SpaceX were under investigation from the DOJ based on discriminating against non-citizens and non-permanent residents (people without a green card) in their hiring process. This all came under way when a complaint was issued from a former applicant who says that they were not hired because of their citizenship status. The applicant was allegedly in line to be hired and turned away after being asked about citizenship status.

I was not able to find out whether or not the applicant who hired the complaint was even a legal immigrant after reading the full subpoena, but assuming that he is, there is still a law that prevents non U.S. citizens from working on companies that develop space launch technology. The law dictates exactly this because of how similar rocket launch technology is with warhead technology. They are not so similar, but there is the potential for warhead technology to be based off of rocket technology.

So, the logic then goes that a non-U.S. citizen working on rocket launch technology is a national security risk as it is letting unchecked people work on and learn how to create warhead missiles.

Whether you agree with this law or not, it still is a law, making me unsure why Elon Musk is under investigation for abiding by the law and not hiring a person who is not allowed to work for SpaceX anyways. In fact, if he did hire this person, he would have broken the law.

Is there anything that I am missing as to why Elon Musk and SpaceX are being investigated? Do you agree with this law?
